Privacy Policy

This request aligns with HIPAA compliance requirements, particularly under the HIPAA Privacy Rule, which governs the use and disclosure of protected health information (PHI). However, to ensure full compliance, the authorization should meet the following criteria: 

  • Explicit Authorization: The document must clearly state that the individual is authorizing The Aether Loop to use their medical information for specified purposes. 

  • Scope of Information: It should define the types of PHI being disclosed, including identifiable details such as name, birthdate, and medical history. 

  • Purpose of Use: The authorization must specify how the information will be used (e.g., marketing, research, or service recommendations). 

  • Right to Revoke: The individual must be informed that they can revoke the authorization at any time, and the process for doing so should be outlined. 

  • Expiration Date: HIPAA requires that authorizations include an expiration date or event (e.g., one year from approval). 

  • Plain Language: The document should be written in clear, understandable language to ensure informed consent. 

Additionally, HIPAA restricts the use of PHI for marketing unless the individual explicitly consents. If The Aether Loop intends to use PHI for marketing purposes, the authorization must clearly state this and ensure that no third-party disclosures occur without additional consent. 

 

Authorization for Use of Medical Information 
(Effective June 2025) 

The Aether Loop WILL NOT sell your name or contact information to any third party. Above all, we respect and honor your privacy. 

Occasionally, The Aether Loop may contact you about products and services relevant to your health data. For example, if your lab test results indicate an elevated heart risk, The Aether Loop might send you an email about the benefits of an at-home heart monitor with a link to purchase—but we WOULD NOT disclose your name or contact info to the third party offering this monitor. 

To legally contact you about products and services that may be relevant to you, The Aether Loop requires your acceptance of the following Authorization: 

 

I hereby authorize The Aether Loop and its affiliates (“The Aether Loop”) to use my medical information for the purposes listed below. Failing to provide all requested information may invalidate this Authorization. 

My authorization applies to: 
All of my individually identifiable medical information as received by The Aether Loop, including my name, birthdate, contact information (such as email, address, phone number), demographic information, and any other details pertaining to my medical history, mental or physical condition, or treatment. 

The purpose of this Authorization is to permit The Aether Loop to: 
Use the information listed above in connection with marketing, advertising, and promotional activities regarding: 

  • (a) The availability, details, specifications, features, quality, performance, and/or pricing of products, services, and opportunities offered by The Aether Loop and/or third parties. 

  • (b) News, research, and advances in science, health, wellness, nutrition, personal care, and technology that The Aether Loop deems may be of interest to me. 

SMS and Text Communication: 
I agree that The Aether Loop may contact me via SMS and text messages regarding marketing, advertising, and promotional activities, subject to the following conditions: 

  • I can cancel the SMS service at any time by texting “STOP” to the short code. After doing so, I will receive a confirmation message and will no longer receive SMS messages. 

  • If I experience any issues with messaging, I can reply with “HELP” or contact support@theaetherloop.com directly. 

  • Carriers are not liable for delayed or undelivered messages. 

  • Message frequency varies, and message/data rates may apply. 

  • I should contact my wireless provider with any questions about my text plan or data usage. 

Privacy and Revocation: 
I acknowledge that: 

  • Any disclosure carries the potential for unauthorized re-disclosure, which may not be prohibited under certain state laws. 

  • Under California law, recipients of my medical information may not make further disclosures unless they obtain another authorization or if required/permitted by law. 

  • I may revoke this Authorization at any time by providing a written, signed request to The Aether Loop at the address listed below. The revocation will be effective upon receipt, but not retroactively. 

  • I have the right to inspect or obtain a copy of my medical information used or disclosed under this Authorization. 

Unless otherwise revoked, this Authorization will remain effective for one (1) year from the date of my approval.
